ABOUT this Policy
This
Privacy Policy sets out the principles and practices which
Red
Robin
Restaurants
of Canada Ltd. (“Red Robin”) follows regarding the collection,
use and disclosure of personal information about any identifiable
person, including Red Robin’s guests and visitors to its
website.

– WHY AND HOW Red Robin May Collect, Use or Disclose Personal
Information
Subject
to applicable law, Red Robin will identify the purposes for which
personal information is collected, used or disclosed before that
information is collected, used or disclosed, as the case may be.
The
general purposes for which Red Robin may collect, use or disclose
information concerning customers and franchisees include the
following:
1.
to better understand the needs of Red Robin’s customers,
provide promotional and other information about Red Robin and to
respond to specific requests;
2.
to operate and fulfill contests
2.
to add new members to the Red Robin eClub
3.
to comply with legal and regulatory requirements.
Red Robin may from time to time
transfer personal information to a third party for processing or
to provide services, but will use contractual or other means to
provide a comparable level of protection while the information is
in the custody of that third party.
From time to time, Red Robin may wish to use or disclose
personal information for a purpose other than that for which it
was initially collected.
Red Robin will ensure that personal information is not
used or disclosed for that new purpose unless the individual is
informed of the new purpose and gives his or her consent.
Red
Robin may be involved in the sale, merger, consolidation, transfer
or reorganization of some or all of its business at some time in
the future. As part of that sale, transfer or reorganization, Red
Robin may disclose personal information to the acquiring
organization, but will require the acquiring organization to agree
to protect the privacy of the personal information in a manner
that is consistent with this Privacy Policy.
Subject
to applicable legal exceptions, Red Robin will make a reasonable
effort to ensure that the individual is advised in advance of the
purposes for which his or her personal information will be
collected, used or disclosed, and that his or her consent to those
activities is obtained.
As
required by applicable law, consent may be express or implied.
Red
Robin will not, as a condition of the supply of products or
services, or the granting or maintenance of a franchise
opportunity, require an individual to consent to the collection,
use or disclosure of personal information beyond that required to
fulfill Red Robin’s explicitly specified, and legitimate
purposes.
An
individual may withdraw his or her consent to collection, use or
disclosure at any time, subject to legal or contractual
restrictions and the provision of reasonable notice to Red Robin.
If an individual withdraws his or her consent to the
collection, use or disclosure of personal information, he or she
may be unable to access Red Robin products or services or
franchise opportunities.
Principle
3 - Limiting Collection, Use, Disclosure and Retention
Red
Robin will limit the amount and type of personal information collected to that
which is necessary for the purposes identified by Red Robin
Red
Robin will not use or disclose personal information for purposes
other than those for which it was collected, except with the
consent of the individual or as required or permitted by law.
Personal information will be retained only as long as
necessary for the fulfillment of those purposes.
Red
Robin will keep personal information as accurate, complete, and
up-to-date as is necessary for the purposes for which it is to be
used.
However, Red Robin will not routinely update personal
information, unless such updating is necessary to fulfill the
purposes for which the information was collected.
Red
Robin will rely on individual Guests to provide up-dated
information, such as changes to addresses and other contact
information, and changed financial information.
If
an individual successfully demonstrates to Red Robin that personal
information is inaccurate, incomplete, out of date, or irrelevant,
Red Robin will revise the personal information.
If necessary, Red Robin will disclose the revised personal
information to third parties, if any, which were provided with the
wrong information to permit them to revise their records as well.
Red
Robin will use security safeguards to protect personal information
against loss or theft, as well as unauthorized access, disclosure,
copying, use, or modification.
The nature of the safeguards will vary depending on the
sensitivity of the personal information that has been collected,
the amount, distribution, and format of the information, and the
method of storage.
The more sensitive personal information will be safeguarded
at a higher level of protection.
The
methods of protection employed by Red Robin will include: physical
measures, including restricted access to offices;
organizational
measures, such as limiting access on a “need to know” basis;
technological measures, such as the use of passwords
Red
Robin will inform its employees about Red Robin’s policies and
procedures for protecting personal information and will emphasize
the importance of complying with them.
As a condition of employment, employees will be required to
conform to Red Robin‘s policies and procedures concerning the
security of personal information.
Red
Robin will use care in the disposal or destruction of personal
information, to prevent unauthorized parties from gaining access
to the information.
Red
Robin will be open about its policies and procedures with respect
to management of personal information.
Red Robin will make this information available in a form that
is generally understandable. Copies
of this Privacy Policy will be made available to Guests and to
members of the public.

– IndividualS’ Access TO THEIR INFORMATION
Upon
an individual’s request in writing, Red Robin shall inform that
individual of the existence, use, and disclosure of his or her
personal information and the individual shall be given access to
that information, except where the law requires or permits Red
Robin to deny access.
Red Robin
may require the individual to provide sufficient information to
permit Red Robin to provide an account of the existence, use, and
disclosure of personal information.
Red
Robin will respond diligently to a proper request and in any case
not later than 30 days after receipt of the request, unless that
time is extended according to applicable law.
As permitted by applicable law, certain charges may be
applicable in respect of certain requests.
8 - Challenging Compliance
An
individual may direct a challenge concerning compliance with this
Privacy Policy to the Chief Privacy Officer.
Red Robin will
establish procedures to receive and to respond to complaints or
inquiries about Red Robin ‘s policies
and practices relating to the handling of personal information.
The
complaint procedure will be easily accessible and simple to use Red
Robin will investigate all complaints.
If Red Robin finds
that a complaint is justified, it will take appropriate measures, including, if necessary, amending its
policies and practices.
9 - Red Robin’s Accountability
Red
Robin is responsible for all personal information under its
control.
The
Red Robin Privacy Officer (the “Chief Privacy Officer”) is
